Privacy protection in the transmission of personal data in business – insights from Lithuania
Beinoravičius, Darijus; Keršulienė, Violeta
In recent decades extremely rapid technological advances have been seen that have changed many areas of daily life and the business environment. These technological advances are leading to the increasing use of electronic communications networks and cloud technologies by individuals, businesses, and organizations to provide services, store, and manage records, especially in the electronic space. The increasing use of these links offers an unprecedented opportunity to systematically collect and use a variety of data (including personal data) for different purposes. Information and data collected and processed with the help of technology are used not only for the purposes of meeting the needs of natural and legal persons but for various other reasons too. In the context of the collection and the use of personal data, which is very widespread in business relations, ensuring the individual’s right to privacy becomes problematic, especially if the data have to be transferred to third countries outside the EU. The authors of the article provide an example of how the case of data transfer to a third party was resolved in the Lithuanian courts. It also provides insights into how data transfers to third (non-EU) countries will change according to the Standard Contractual Clauses (SCCs), which will take effect on December 27, 2022.

Mediation as an alternative means to the business dispute resolution

Mediation as an alternative means to the business dispute resolution
Trinkūnienė, Eva; Trinkūnas, Vaidotas
In business, disputes often arise over contractual relationships when contractual obligations are not properly fulfilled. The potential risk of disputes must always be assessed. Timing and adherence to agreed deadlines are very important in business, as any delay can cause significant damage, and the legal entity can suffer significant losses. In a dispute between business partners, people tend to go to the court and fight there to the fullest rather than reach an amicable settlement, but there is always a winning and losing party in a litigation. From a long-term perspective, it will be impossible for the disputing parties to work together in the future, and the losing party will always feel great resentment towards the winner. Therefore, litigation is not always an attractive option and in this case mediation is a great way to resolve business disputes due to its expediency. Mediation is a dynamic, structured, interactive process which is focused on the needs, rights, and interests of the parties. It also helps to find the optimal solution and encourages open communication. This article presents the possibilities and perspectives of the application of mediation in Lithuania by reviewing global practice.

Research methodology – the structural-functional method (for revealing the influence mechanism of social risks on the state of social security), the comparison method (for comparing the main measures for ensuring human social security between Ukraine and other countries). Findings – recommendations for the formation of the state policy for ensuring human social security under hybrid war will create conditions for enhancing the quality and efficiency of living standards. Research limitations – some indicators are only of a qualitative nature and cannot be measured to analyze the impact of social risks and threats on the main indicators of human social security. Practical implications – improvement of a risk-oriented method in human social security under hybrid war is an effective method of developing the existing human social security in Ukraine. Originality/Value – formation of state policy of human social security under hybrid war is a new stage of comprehensive relations, which opens the way for further progressive reforms. Great importance is to use the experience gained by other countries but also take into account the peculiarities of the socio-economic situation in Ukraine.

Jurkevičius, Vaidas; Bublienė, Raimonda; Šeputaitė, Dominyka
In order to ensure the sustainability in agency relationships, the agent must act in accordance with the fiduciary duties, the breach of which presupposes the negative legal consequences on the side of the agent. The purpose of this article is to reveal the content of agent’s fiduciary duties and the legal consequences of their breach in Lithuania maefrom a comparative perspective. It is concluded that neither the legal regulation nor the case law in Lithuania discloses the content of the agent’s fiduciary duties and the legal consequences of their breach.
