Vietovės lygmens bendrųjų planų objektai, reglamentų nustatymo ypatumai bei teisiniai aspektai, viešosios erdvės

Abstract

Straipsnyje nagrinėjami naujojoje Teritorijų planavimo įstatymo (toliau tekste – Įstatymas) redakcijoje numatyti vietovės lygmens bendrųjų planų objektai, planų rengimo ir reglamentavimo ypatumai bei teisiniai aspektai. Teigiama, kad Įstatyme numatyti rengti miestų dalių, miestelių dalių, kaimų ir viensėdžių bendrieji planai nėra bendrojo planavimo objektai. Racionaliau yra rengti šių teritorijų detaliuosius planus. Analizuojant Vilniaus miesto savivaldybės teritorijos bendrojo plano iki 2015 m. sprendinius teigiama, kad Lietuvoje nėra parengtų bendrųjų planų, kuriuose būtų nustatyti visi detaliesiems planams privalomo teritorijos naudojimo reglamento reikalavimai (kaip numatyta Įstatyme), todėl vadovaujantis bendraisiais planais negali būti rengiami statinių projektai. Patvirtinus naujos redakcijos Teritorijų planavimo įstatymą (įsigaliojo nuo 2014- 01-01), teritorijų planavimas iš aiškios teritorijų planavimo dokumentų rengimo sistemos (ankstesnės Teritorijų planavimo įstatymo redakcijos) tapo tik chaotiška planavimą sudarančių dalių visuma. Planavimas kaip sistema jau neegzistuoja, nes įvairūs teritorijų planavimo dokumentai funkcionuoja (ar gali funkcionuoti), ir jų rengimo (keitimo ir koregavimo) procesai vyksta savarankiškai – kaip atskiri pavieniai elementai, t. y. tarpusavyje gali ir nesąveikauti, neturėti įtakos vienas kitam. Sukrauti į krūvą jie sistemos nesudaro.

The article analyzes the new Spatial Planning Act (hereinafter – the Law) version of the site to determine the level of interest the general plans for the development and regulation of the practical and legal issues.
