Tikybos mokymo konstitucinis teisinis reglamentavimas: raida ir dabartis

Abstract

Straipsnyje apžvelgiama tikybos mokymo raida. Daug dėmesio skiriama tikybos mokymo konstituciniam teisiniam reglamentavimui Lietuvos Respublikoje 1918-1940 m. Pabrėžiama, kad pirmią kartą tikybos mokymą konstitucionalizavo 1922 metų Lietuvos Valstybės Konstitucija, kurios 80 g nustatė, kad religijos mokymas mokyklose vra privalomas, išskyrus mokyklas, įsteigtas vaikams, kurių tėvai nepriklausojokiai tikybinei bendruomenei. Atskleidžiama tikybos mokymo padėtis okupacijos metais remiantis literatūriniais šaltiniais, LTSR prokuratūros medžiaga (panaudota šiame straipsnyje pirmą karta). Daugiausia dėmesio skiriama šios problemos konstituciniam teisiniam reglamentavimui atkūrus nepriklausomybę. Mėginama aptarti problemas, kurios iškyla įgyvendinant Lietuvos Respublikos Konstitucijos bei sutarties su Šventuoju Sostu nuostatas.

The article reviews the development of teaching religion. Considerable attention is devoted to the Constitutional legal regulation of teaching religion in the Republic of Lithuania in 1918-1940. It is stressed that the constitutionality of teaching religion was mentioned in the 1922 State Constitution of Lithuania, whose 80th article determined that the teaching of religion was mandatory in schools, except for schools, founded for children whose parents did not belong to any religious community. The situation of teaching religion in the occupation years are presented relying on literary sources, materials of the LSSR Prosecutor General (revealed for the first time in this article). Particular attention is devoted to the constitutional legal regulation of this problem after the restoration of independence. There is an attempt to discuss the problems which arise in implementing the articles of the Constitution of the Republic of Lithuania as well as the treaty with the Holy See.
