Statybų plėtros planavimas įvertinant trečiųjų asmenų interesus

Abstract

Disertacijoje nagrinėjamos statybų plėtros planavimo, įvertinant trečiųjų asmenų interesus, problemos. Pagrindiniai tyrimo objektai yra teisinė investici-nio statybos proceso reglamentavimo bazė; teritorijų planavimo teisiniai pažei-dimai, planuojant statybos investicijas; pažeistų trečiųjų asmenų teisių gynimo proceso, įgyvendinant investicinius statybos projektus, modeliavimas; statybos planavimo sprendimų matematinis modeliavimas. Šie objektai yra svarbūs įgy-vendinant statybos projektą, nes teisminio ginčo atsiradimas yra nepageidauja-mas rizikos veiksnys, galintis sužlugdyti visą projektą. Disertacijos tikslas – statybos planavimo sprendimų modeliavimas, įverti-nant trečiųjų asmenų interesus, siekiant sumažinti teisminio ginčo atsiradimo riziką, įgyvendinant statybos investicinį projektą. Disertaciją sudaro įvadas, keturi skyriai, rezultatų apibendrinimas, naudotos literatūros sąrašas, autorės publikacijų disertacijos tema sąrašas ir 3 priedai. Įvade aptariama tiriamoji problema, darbo aktualumas, aprašomas tyrimų objektas, formuluojamas darbo tikslas ir uždaviniai, aprašoma tyrimų metodika, darbo mokslinis naujumas, ginamieji teiginiai. Kiekviename skyriuje apžvelgiama ir analizuojama mokslinė bei metodinė literatūra, atitinkanti kiekvieno skyriaus tematiką. Pirmajame disertacijos skyriuje sprendžiamos sveikos ir harmoningos gyve-namosios bei darbo aplinkos išsaugojimo miestų plėtros metu problemos. Antrajame disertacijos skyriuje nustatyti trečiųjų asmenų teisių pažeidimai, plėtojant statybas. Sudarytas trečiųjų asmenų teisių pažeidimų klasifikatorius. Suformuluota trečiųjų asmenų teisių pažeidimų samprata. Trečiajame disertacijos skyriuje atliktas ginčo proceso dėl galbūt pažeistų trečiųjų asmenų teisių modeliavimas, taikant sprendimų medžio diagramą. Ketvirtajame disertacijos skyriuje atliktas statybos planavimo sprendimų modeliavimas, įvertinant trečiųjų asmenų interesus, t. y. parengtas matematinis modelis asmens, investuojančio į statybas ir susiduriančio su visuomenės pasi-priešinimu, siekiančio maksimalaus pelno galimoms elgesio strategijoms įvertin-ti. Sukurtas optimalių strategijų radimo uždavinys, naudojant daugiažingsnį op-timizavimą, t. y. stochastinį dinaminį programavimą. Disertacijos pabaigoje pateikiamos išvados ir literatūros šaltinių sąrašas. Disertacijos tema paskelbti šeši moksliniai straipsniai: trys – mokslo žurna-luose, referuojamuose Mokslinės informacijos instituto (ISI) duomenų bazėse (ISI Web of Science leidiniuose); du – mokslo žurnaluose, referuojamuose kitose tarptautinėse duomenų bazėse, ir vienas – kituose leidiniuose. Disertacijos tema perskaityti trys pranešimai mokslinėse konferencijose Lietuvoje.

The dissertation deals with problems of planning development of construc-tion by taking into account interests of the third parties. The several subjects were formulated: the legal basis of construction investment process regulation; delicts of territorial planning while planning construction investments; model-ling the process for defense of third party rights infringed during the implemen-tation of construction investment projects; mathematical modelling of construc-tion planning decisions. The aim of the Thesis is to model the construction planning decisions by taking into account interests of the third parties, in order to minimize the risk of litigation initiation related to the implementation of construction investment pro-jects. The dissertation consists of an Introduction, four chapters, a summary of the findings, references, list of author’s publications and three annexes. The Introduction discusses the problem being studied, relevance of the pa-per, describes the subject of studies, formulates the goal and tasks of the paper, describes the methodology of studies, originality of dissertation, defendable sta-tements. Each chapter of the dissertation overviews and analyzes scientific and methodic literature directly related to the chapter topic. The first chapter of the dissertation deals with the problems of preservation of the healthy and harmonious residential and working environment during ur-ban development. The second chapter of the dissertation determines the violations of the rights of the third parties during construction development. The classification of viola-tions of the rights of the third parties has been formed. The third chapter of the dissertation performs the modeling of the process of the dispute on the possibly violated rights of the third parties, by applying the decision tree diagram. The fourth chapter of the dissertation performs the modelling of construc-tion planning decisions by taking into account the interests of the third parties, i.e. develops the mathematic model in order to assess possible behaviour strate-gies of the investor, investing in construction process and facing the public op-position, who seeks maximum profit. Six scientific articles are printed on the subject of the dissertation: three of them in the scientific journals abstracted by the databases of the Institute for Scientific Information (publications of the ISI Web of Science); two of them in the scientific journals abstracted by the other international databases. Three re-ports have been read on the subject of the dissertation in scientific conferences in Lithuania.
